IAPP – GenAI & Data Protection (Brussels, BE)

The Director of the AI Regulation Chair Professor Theodore Christakis will speak in a panel dedicated to regulation of General Purpose AI (GPAI) during the European Data Protection Congress of IAPP.

This panel will undertake a comprehensive examination of the regulatory landscape to strike a balance between the risks and rewards of this rapidly evolving technology.
The discussion will commence with an in-depth analysis of the EU AI Act and the GDPR, exploring their interplay including potential synergies and where the two distinguish themselves from one another. The panel will then delve into the application of the GDPR in the training of AI models if and where personal data are involved, with a particular focus on the legal basis for such training provided that GDPR applies to. This segment will critically evaluate the implications of the Google Spain LS case (CJEU – C 131/12), also known as the “right to be forgotten” decision, on the use of public data and the reliance on legitimate interest as a legal basis for AI model training using publicly available data on the Internet. Furthermore, the conversation will expand to consider the broader implications of this debate on the involvement of publicly available and potentially sensitive data in AI model development, and how these concerns can be addressed while still promoting innovation and progress in the field of GenAI.
